I was told by my local Tesla store that I should call customer service and ask for them to transfer FSD to my wife's MY while we wait... I'll save you all the trouble, don't bother asking.

Wasn't Ashok the one on the earnings call that was on with Elon stating that FSD for other car makers would just be a simple 'flip the switch' for FSD? And Tesla still can't get CT to work

weird, isn't it? Almost like they just say things for the sake of saying them....

I finally got 12.5 on my hardware 3 Model Y. They gave me 12.5.2.1 the one without ASS.

It did really well on the first drive on my normal route but on the way back it made 3 mistakes that I had to override. The big one was it tried to go to Daytona Beach instead of Orlando. Even though the map was showing the correct ramp to go on. Not sure what was up with that.

I like the speed it maintains much better when it is on auto speed. It's better than 12.4.3. It's also much more brave to make turns with cars coming. I let it do its thing and a couple times it was very aggressive.

It drives more naturally but still it's trying to pass too much. Passing into turn only lanes or passing when the turn is coming up soon then having to get right back over to make the turn.

I’ve been incredibly patient thus far, but if September comes and goes without FSD, I’m going to speak to an attorney and see what my options are. Most of the value of Founders Edition was in the FSD capabilities. So, I figure if the usable life of my truck is 10 years with FSD valued at $12k, we’re all down $100/month every month FSD slips. We shouldn’t tolerate this.

Well, I’m an attorney. I’m not going to provide you legal advice over the interwebs, but, I’ll tell you what I’m going to do:

I’m going to be ā€œActuallyā€ Incredibly Patient (AIPā„¢ļø). I’m going to remember that I bought this car full well knowing that it wasn’t coming with FSD and several accessories that were part of my purchase price and that I both acknowledged and consented to that state of being at the time that I sent Tesla money.

I’ll just go ahead and remember that no date of delivery was promised to me for these accessories and FSD and then just wait patiently until Tesla hands me my FSD and ASS after they deem it’s ready to be distributed to the public rather than wasting a whole bunch of time, energy and money only to have my ASS handed to me in court.

Because, I’ll know that when Tesla is doing the calculus as to whether they’re going to rush a product out so that someone who was given no firm date of delivery at the time of their purchase is investigating whether they should file a pointless lawsuit vs. rushing out potentially dangerous software which will do both financial and reputational harm, that they’re going to ignore the former and focus on the latter 100% of the time.

I’ll recall that I haven’t lost a single dollar because of this ā€œdelay,ā€ since, I got exactly what I bargained for which was: (1) a car today and (2) some other shit at a unspecified later date.

I’ll remember that no matter how earnest or wildly inaccurate any promises or statements Elon made outside of the four corners of my signed agreement are, that those promises aren’t worth the electrons they’re printed on since they don’t modify my contract. ??ā€ā™‚

But again, that’s just what I’m going to do. You should do what feels right to you.

It’s hard to find a good lawyer these days… In between the four corners of my agreement it states ā€œYou agree to purchase the vehicle (the ā€œVehicleā€) described in your Vehicle Configuration from Tesla, Inc.ā€ and in the Vehicle Configuration addendum it states ā€œFull Self-Driving Capabilityā€. I’d argue without the software, I do not have these capability. Now, I remember Tesla had me accept a separate web term related to FSD, post order, obviously because they were worried about exposing themselves to unnecessary liabilities. I might not have a great case, but I’d still like to pressure them to do right by their customers.

This is spot on. I'm a litigation attorney and I agree completely. This case wouldn't even be worth the filing fee.

You/your attorney may argue whatever you like. That doesn’t make them good arguments. Where you would probably want to begin is with a good definition of what having the ā€œcapabilityā€ to do something actually means. But, again, I’m not going to provide you with free legal advice, I’m just going to tell you what I would do.

For example; I am capable of jogging. It’s not something that I choose/like to do; so, I don’t. But, I have the necessary equipment. [Being nominally ā€œcapableā€ of doing something also doesn’t warrant that I will be particularly good at it or achieve any particular level of competence. ? You know, I wonder if there’s any reason that that word was chosen to describe this offering? Nah, it’s probably completely accidental, arbitrary, happenstance - but, I digress …?].

I’ll bet your Cybertruck, just like mine, has the necessary equipment to be capable of ā€œfull self driving.ā€ ?

Incidentally, reading between the lines, it’s almost as if you’re trying to suggest that I’m not a good lawyer. ????

I wonder if you think Tesla has good lawyers? ? [Which is far more salient.]

Perhaps, you and Don (or Donna) Quijote, Esq. will find out. ?
