Tesla has replaced some of its US employees who were let go as part of a big wave of layoffs earlier this year with foreign workers using H-1B visas, which CEO Elon Musk is now campaigning to increase.


Over the last week, Elon Musk has been promoting the increase of H-1B visas, which are used to bring foreign workers into the US for “specialty occupations.”

And most of those workers will buy Teslas - it’s a win all around. Better than hiring illegals, and cheaper than hiring us Americans. Again another win for business. If there were a pool us Americans that valued STEM curiosity and interest - and limit on hiring H1Bs, it wouldn’t be a problem.

But rarely does a parent tell their kid to go be an engineer, electrician or the like anymore. When kids are driven to be the next social media star, what do you expect.

They're required to lay off H1Bs first, but they also cannot do the fire/rehire dance with H1Bs they're doing with others... if they lay them off they have a limited time to get a new job and do not get unemployment benefits in the gap.

This is just flatly untrue.
  • This isn't a thing people do, and you provided no such information.
  • H1Bs are limited.
  • And we hire more engineers than we train, even including foreign born but US trained students.

They can't with the same pool, correct.

They're always more pools.

In a sense, I agree with what you are saying. It's a nuanced issued for sure. I think the following has some good points (ignore the title, there is a lot more said):

H1B visas are only granted if you can prove that the position cannot be filled with domestic people. If domestic people were doing the job and let go then there is really no way that Tesla could fill those positions with H1Bs without potentially getting sued.

Long post - get a popcorn! :p

H1B is a highly nuanced topic. I know many people on H1B and heard so many of their stories at a personal level. It has multiple perspectives:

H1B Employer:
1. Bring the cream of the crop. Some other countries paid a lot to educate these people. You harvest and bring them here when they are in their prime youth. No wonder CEOs love them.
2. High ROI for employer. H1B base salaries are much lower, especially in outsourced or contract roles. You get the same work done for half the price. When budget cuts are strong, H1B employees do come in handy. Another option is to outsource the work outside the US. Hiring non-H1B is sometimes not an option as there is no money. The company will have to lay off someone to afford and show good numbers on the balance sheet. It's pure numbers.

Government:
1. H1Bs make solid money as they grow into higher roles. They pay high taxes. They invest in real estate. Some H1B holders eventually make it into top CEO roles, such as Elon Musk, Satya Nadella, and Sundar Pichai.
2. A small portion of H1B is indeed abused. This is where the confusion happens. Some less talented people can also get in and are willing to work for less money, and some American jobs get replaced by these people. This is the dark side of H1B; however, this is a minority. The reason this is a minority is because less skilled people cannot survive a highly competitive IT sector. If you are not performing well for six months, you'll be easily replaced. You can't just cruise through without the intellectual horsepower. Getting a job is easier than maintaining it and doing well. Don't believe so - go talk to someone in Meta or Amazon.

H1B Employee:
1. You cannot quit or change jobs easily. If you quit or get fired/laid off, you must find a job in two months. Otherwise, you'll be staying illegally.
2. It takes 15-20 years to get a Green Card. Until then, your ass belongs to the employer. It's pretty much a fancy IT slavery.
3. Many do regret giving up their freedom. I know one guy who moved back to and started a company in his home country. He is quite successful now. Nowadays, top talent is impatient to wait for several years to venture into entrepreneurship. If the US shuts down H1B, it's a blessing in disguise for these top talent. Elon sees this well, and he prefers this top talent to work for him instead of venturing on their own or getting wasted without opportunities.

Funding education:
In these countries (mainly China and India), education is the lifeblood. Parents sacrifice everything just to educate their kids. I know an Asian guy whose parents sold their ancestor's property to fund his Masters. Parents don't loan money to kids for education. They just do it as they think it's their responsibility to fund kid's education till grad/undergrad. I think this is the main reason why many US kids don't push beyond certain education. I honestly don't think it's because of skills. It's purely financial, and parents push a LOT for kids to get educated.

All these things are not known till you have friends or colleagues on H1B. People just turn everything into good/bad to create polarized groups. There are a lot of grey areas when it comes to certain sensitive topics such as H1B.
